Any property that might fall under USACE regulation should request jurisdictional determination before applying for permits. Failure to comply with federal regulations can result in cease and desist orders, investigations, restoration requirements, imprisonment, penalties, and/or fines. Civil and administrative penalties for violating the law can cost up to $68,446 per day.
